Please read these Terms and Conditions carefully before using this website or engaging with any services offered by The Calm Coach.
1. Interpretation
Words with capitalised initials have specific meanings as defined below. These definitions apply whether the terms appear in singular or plural form.
2. Definitions
- “Company” (referred to as “We,” “Us,” or “Our”) refers to Victoria Willis, trading as The Calm Coach, 7 Arundel Drive, Grantham, NG31 8WN, United Kingdom.
- “Website” refers to https://calm-coach.com
- “Services” refers to online group wellbeing sessions, guided breathing practices, relaxation techniques, and associated content delivered by The Calm Coach to corporate organisations and schools.
- “Corporate Programme” refers to a purchased package of weekly online group wellbeing sessions delivered to employees via Microsoft Teams.
- “School Initiative” refers to the free wellbeing content provided to schools as part of The Calm Coach community programme, including pre-recorded video content suitable for use in assemblies and classrooms.
- “Content” refers to all materials, videos, techniques, and information provided by The Calm Coach, whether delivered live, pre-recorded, or in written form.
- “Terms” refer to this agreement, including any related policies and disclaimers.
- “You” refers to any individual or organisation accessing or using Our Website, Content or Services.
3. Acknowledgment
These Terms govern the use of Our Website, Content, and Services. By accessing or using them, You agree to be bound by these Terms. If You do not agree, please discontinue use immediately.
Your use of Our Website and Services is also subject to Our Privacy Policy and Cookie Policy. Please review both carefully.
4. Nature of Services
The Calm Coach provides online group wellbeing sessions and video content focused on simple, gentle breathing techniques, guided relaxation, and heartbased mindfulness practices.
Our services are not therapeutic, counselling, or clinical in nature. They are not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment. No individual sessions are offered.
Sessions and content are designed to be accessible, gentle, and suitable for general wellbeing. We do not use breathwork techniques designed to induce altered states, process trauma, or produce any clinical outcome.
5. Corporate Programmes
Corporate Programmes are governed by a separate written Client Agreement between The Calm Coach and the purchasing organisation. In the event of any conflict between these Terms and a signed Client Agreement, the Client Agreement takes precedence.
Payment: Full payment is required before any Corporate Programme commences. No sessions will begin until payment has been received in full.
Refund Policy: The programme fee is non-refundable once payment has been made. By proceeding with payment, the Client Organisation accepts this condition.
Cancellation by The Calm Coach: In the event that The Calm Coach is unable to fulfil a programme due to circumstances on the part of the service provider, a proportionate refund will be issued for sessions not yet delivered.
Recording: Sessions may not be recorded, reproduced, or distributed by the Client Organisation without prior written consent from The Calm Coach.
6. School Initiative
The Calm Coach provides free wellbeing video content to schools as part of a community initiative. This content is provided at no charge and is subject to the following conditions:
- Video content is provided for use within the receiving school only and may not be shared externally, uploaded to public platforms, or used for any commercial purpose.
- Before any video content is shown to children, it must be watched in full by an appropriate school employee. This is a condition of use.
Content should be played by a member of school staff who remains present throughout. - The school accepts responsibility for determining whether the content is appropriate for its pupils, taking into account any individual needs, sensitivities, or safeguarding considerations.
- All content remains the intellectual property of Victoria Willis / The Calm Coach.
- Where a live in-person or remote session is agreed separately, a current enhanced DBS certificate will be provided by Victoria Willis prior to any visit, and all school safeguarding policies will be observed.
7. Age Suitability
Corporate Programmes are intended for adults (18 years and over) participating as employees of a client organisation.
School Initiative content is specifically adapted for school-age children (primary and secondary) and is designed to be delivered under the supervision of a qualified member of school staff. Direct access to this content by children via this website is not intended or facilitated.
8. Intellectual Property
All Content created and provided by The Calm Coach – including session materials, videos, techniques, written resources, and website content – remains the intellectual property of Victoria Willis / The Calm Coach and is protected by copyright.
Content may not be reproduced, copied, shared publicly, adapted, or used commercially without prior written consent.
9. Links to Third-Party Websites
Our Website may contain links to third-party websites which We do not own or control. We are not responsible for the content, privacy policies, or practices of external sites and encourage You to review their terms before engaging with them.
10. Limitation of Liability
To the fullest extent permitted by law, Our liability for any claims related to Your use of Our Website, Content or Services is limited to the amount You have paid Us for Services in the preceding 12 months, or £100, whichever is greater.
Under no circumstances shall We be liable for indirect, incidental, or consequential damages, including but not limited to lost profits, data loss, or personal injury arising from Your use of Our Website, Content, or Services.
The Calm Coach holds Public Liability and Professional Indemnity insurance. Nothing in these Terms limits Our liability where such limitation is not permitted by law.
11. Termination
We reserve the right to suspend or terminate access to Our Website, Content or Services at any time, without notice, if You violate these Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Dispute Resolution
If You have any concerns or disputes, We ask that You contact Us in the first instance to attempt an informal resolution before pursuing any legal action.
14. Severability
If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full effect.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Where changes are material, existing clients will be given 28 days’ notice before the changes take effect. Continued use of Our Website or Services after any update constitutes acceptance of the revised Terms.
